and the provision of services by electronic means
effective from 1 September 2026
§ 1. General provisions
These Terms and Conditions set out the rules for using the okulary-3d.pl internet portal, hereinafter referred to as the “Portal”, and the rules for the provision of services by electronic means through it.
The operator of the Portal and the service provider is:

hereinafter referred to as the “Operator”.
The Portal is a specialist website devoted in particular to stereoscopy, spatial imaging, 3D techniques, 3D photography and film, optics, anaglyph, polarisation and lenticular techniques, VR/AR technology, and the history and contemporary applications of spatial imaging.
The Portal provides, among other things:
a) articles, guides and informational materials,
b) the 3D Archive and historical materials,
c) the Community Gallery,
d) 3D LAB online tools,
e) image processing and creation functions,
f) artificial intelligence-based functionalities, if made available,
g) a user account and community functions,
h) a newsletter,
i) functions related to the online store.An online store also operates within the okulary-3d.pl domain. The rules governing purchases, payments, delivery, withdrawal from the contract, returns and product complaints are set out in separate Store Terms and Conditions. These Terms and Conditions do not replace the Store Terms and Conditions.
The Terms and Conditions are made available free of charge in a manner that enables them to be displayed, saved and reproduced.
§ 2. Definitions
For the purposes of these Terms and Conditions, the following terms shall have the meanings set out below:
Operator – Elvenica Sp. z o.o., whose details are provided in § 1.
Portal – the website available at okulary-3d.pl, together with its language versions, subpages and functionalities.
User – any person using the Portal.
Registered User – a User who has an active Account on the Portal.
Account – an individual account that enables the use of functionalities requiring login.
User Content – photographs, images, stereopairs, files, descriptions, comments, names, materials and other content submitted by the User to the Portal.
Gallery – the part of the Portal that allows Registered Users to upload their own stereoscopic materials intended for publication.
3D LAB – a set of tools used, among other things, to create, convert, prepare and present stereoscopic materials.
AI Service – a functionality using an artificial intelligence system or model, in particular to generate, analyse, modify, reconstruct or process images or other content.
Paid Service – a Portal service whose use requires payment of the price indicated to the User before it is activated.
Store – the online store operating within the okulary-3d.pl domain, whose activities are governed by separate Store Terms and Conditions.
§ 3. Rules for using the Portal
Browsing the Portal’s publicly available content does not require the creation of an Account.
Some functionalities, in particular publishing materials in the Gallery, using selected community functions, managing one’s own materials and selected tools, may require login.
The scope of available functionalities may depend on:
a) the type of Account,
b) login status,
c) the language version of the Portal,
d) the availability of a given tool,
e) technical limitations,
f) the free or paid usage limit used, if such a limit applies.The Operator may develop the Portal, add new functionalities, modify existing ones or withdraw functions whose maintenance has become technically, economically or legally unjustified.
Material changes concerning paid services or the rights of Registered Users shall be made with due regard for contracts already concluded and without prejudice to rights arising from mandatory provisions of law.
§ 4. Technical requirements
Proper use of the Portal requires:
a) a device with Internet access,
b) an up-to-date web browser supporting HTML5, JavaScript, CSS and mechanisms for essential cookies,
c) in the case of registration – an active email address,
d) in the case of graphic tools – a device and browser with sufficient resources for image processing.Some tools use browser functions such as Canvas, graphic file processing or local generation of output files. Their performance may depend on the User’s device.
The User should use up-to-date software and protect their device against unauthorised access and malicious software.
§ 5. User Account
Creating a basic Account on the Portal is free of charge.
The current registration form requires the following:
a) first name or username,
b) email address,
c) password and its confirmation,
d) acceptance of these Terms and Conditions and the Privacy Policy.The User is required to provide a valid email address and details enabling proper use of the Account.
The username may not:
a) infringe the rights of third parties,
b) impersonate another person or entity,
c) contain unlawful, offensive or misleading content.The User is responsible for maintaining the confidentiality of the credentials enabling access to the Account.
It is prohibited to share the Account in a manner that could lead to a breach of the security of the Portal or the rights of other users.
One Account may be used, among other things, to access the Gallery, Portal tools, community functions and functions related to the Store, provided that sales contracts concluded in the Store are governed by separate Store Terms and Conditions.
The Operator may temporarily restrict access to the Account if this is necessary for security reasons, due to suspected unauthorised access or a breach of the Terms and Conditions.
The User may request the deletion of the Account. Deletion of the Account does not entail an obligation to delete data that the Operator is required or entitled to retain under the law, in particular data concerning completed transactions.
§ 6. User obligations and prohibited content
The User is required to use the Portal in accordance with the law, the Terms and Conditions, accepted standards of conduct and with respect for the rights of others.
It is prohibited to transmit through the Portal content that:
a) is unlawful,
b) infringes copyright, industrial property rights or the personal rights of third parties,
c) contains the likeness of a person disseminated unlawfully,
d) incites the commission of a crime or violence,
e) contains malicious software or code that may disrupt the operation of the website,
f) is intended for data phishing, fraud or impersonating other persons,
g) infringes the privacy of third parties,
h) is processed or published in breach of applicable law.It is prohibited to attempt to:
a) gain unauthorised access to other persons’ Accounts or the Portal infrastructure,
b) circumvent security measures, restrictions or service limits,
c) use the services automatically in a manner that causes an excessive load on the system,
d) use the Portal for the purpose of disrupting its operation.
§ 7. Community Gallery and User Content
Registered Users may upload their own materials to the Gallery, in particular stereopairs and other works related to spatial imaging.
Materials uploaded to the Gallery may be subject to moderation before being made publicly available.
The mere uploading of material does not guarantee its publication.
By uploading material, the User declares that:
a) they hold the rights or appropriate authorisations permitting the material to be used in the manner provided for in the Terms and Conditions,
b) its publication does not infringe the rights of third parties,
c) they have an appropriate legal basis for disseminating the likenesses of persons visible in the material, if such a basis is required.The User retains the rights to their User Content.
To the extent necessary for the operation of the public Gallery, the User grants the Operator a non-exclusive and royalty-free right to technically store, scale, create thumbnails of, convert the formats of, display and make the material publicly available on the Portal.
If the material is submitted as public, the User also permits the use of its thumbnail or preview to promote the Gallery or a specific work in the Portal’s information channels, together with attribution of the author according to the details displayed with the work.
The Operator may refuse publication or restrict access to content that infringes the law, the Terms and Conditions or the rights of third parties.
Moderation decisions shall be made in a manner that is as proportionate as possible to the nature of the infringement.
A person who believes that specific content on the Portal is unlawful may submit a report to kontakt@okulary-3d.pl.
Where possible, the report should include:
a) identification of the specific content or page address,
b) an explanation of the reasons for considering the content unlawful,
c) details enabling contact with the reporting person, where providing them is appropriate in the circumstances,
d) a declaration that the report has been made in good faith.A User whose content has been removed or restricted may submit objections to kontakt@okulary-3d.pl.
§ 8. 3D LAB tools and image processing
3D LAB includes tools used in particular for creating anaglyphs, aligning stereopairs, converting stereoscopic formats, preparing lenticular materials, handling MPO files and creating spatial animations.
In the currently available tools that use local processing in the browser, the User’s images are processed on the User’s device and are not transmitted to the Operator’s server for this purpose.
Information displayed for a specific tool concerning how data and files are processed is binding with regard to the operation of that tool.
If, in the future, a specific tool requires a file to be uploaded to the Operator’s server or to an external technology provider, the User will be appropriately informed before processing begins.
The User should retain original copies of uploaded or processed materials. The Portal’s tools are not an archiving or backup service unless expressly indicated otherwise for a specific function.
The results generated by the tools depend, among other things, on the quality of the input material, the parameters selected by the User and the technological limitations of the relevant algorithm.
§ 9. Functionalities using artificial intelligence
The Portal may provide tools that use artificial intelligence models, in particular generative AI.
AI Services may be used, among other things, for:
a) generating images,
b) modifying images provided by the User,
c) reconstructing materials or improving their quality,
d) stylistic transformation,
e) creating variants of material,
f) image analysis,
g) generating or processing text and other content related to the functionality of the Portal.Some AI functions may use external models or services provided by specialised technology providers.
If the use of a specific AI function requires material to be transmitted outside the Operator’s infrastructure, information about this method of processing and relevant data protection information shall be made available to the User in accordance with applicable law and the Privacy Policy.
The User should not submit the following to AI systems:
a) materials to which they do not hold the required rights,
b) confidential information of third parties without an appropriate basis,
c) personal data whose processing using the given function is not lawful,
d) unlawful content.The User is responsible for selecting the input material and for the manner in which the obtained result is used, subject to the Operator’s liability arising from mandatory provisions of law.
The output of an AI model may contain errors, inaccuracies, artefacts or elements that the User did not expect. The User should verify the output before using it in a manner that has legal, professional or commercial consequences.
The Operator does not guarantee that every AI output:
a) will be unique,
b) will constitute a work protected by copyright,
c) will enable exclusive rights to be obtained in its elements,
d) will be suitable for every purpose intended by the User.In the case of content generated or modified using AI, the Operator applies the transparency and content labelling measures required by law, to the extent appropriate to the nature of the service concerned and the Operator’s role.
The User may not use AI functions to create content intended for unlawful impersonation of other persons, fraud or any other violation of law.
§ 10. Paid Portal functionalities
Basic use of the Portal’s public content and the creation of a basic Account are free of charge.
Some current or future Portal functionalities may be subject to a fee.
This applies in particular to functions requiring the Operator to use paid external technology services, including artificial intelligence models used for:
a) generating images,
b) processing or modifying images,
c) advanced analysis of materials,
d) other operations that incur charges for external API services or computing infrastructure.Merely holding an Account does not create an obligation to make payments.
Before a paid function is activated, the User shall receive information at least about its price or the method of determining the price and the basic characteristics of the service.
A paid function requiring separate confirmation shall only be activated after the User performs an action that unambiguously indicates an obligation to pay.
The Operator may apply, in particular, payment:
a) for a single operation,
b) for a package of operations or credits,
c) for a specified usage limit,
d) under another model clearly presented to the User before the contract is concluded.If consumer provisions concerning digital services or digital content apply to a paid service, the Operator shall provide the information and rights required by law.
If commencing the performance of a paid digital service before the expiry of the withdrawal period requires the User’s express request or consent and their acknowledgement of the relevant legal consequences, such consent shall be obtained before the provision of the service begins.
This section applies to paid digital services constituting functionalities of the Portal. The sale of goods and other products through the Store is governed by separate Store Terms and Conditions.
§ 11. Intellectual property rights
Editorial content, graphic elements, the layout of the Portal, software, databases, logos, designations and other elements of the Portal may be protected by copyright, industrial property rights or other rights of the Operator or third parties.
Use of the Portal does not entail the transfer to the User of any rights to its content.
The User may use the Portal’s materials to the extent permitted by law and by the functions made available by the Operator.
The rules concerning User Content are set out in § 7.
With regard to outputs created using automated or AI tools, the scope of the User’s potential rights depends on the nature of the output, applicable law and, where relevant, the terms governing the technology used to generate it.
The Operator does not guarantee that copyright will arise in an output generated wholly or partly automatically.
§ 12. Personal data and privacy
The controller of personal data processed in connection with the operation of the Portal is Elvenica Sp. z o.o.
In connection with maintaining the Account, the following may be processed in particular:
a) first name or username,
b) email address,
c) data used to authenticate the Account,
d) settings and information related to the Account,
e) information concerning User Content and activity carried out through the Account.In connection with use of the Portal, necessary technical and usage data relating to communication with the website, security, the user session and analysis of the Portal’s operation may also be processed in accordance with the Privacy Policy and applicable law.
If the User uses a functionality that requires a file to be uploaded to a server, the uploaded files and information necessary to perform the selected operation may also be processed.
In the current 3D LAB tools expressly marked as operating locally, images remain on the User’s device and are not uploaded to the server to perform the relevant operation.
In the case of AI functions using external services, the scope of information transmitted depends on the specific tool and is described in accordance with applicable data protection rules.
Subscription to the newsletter is independent of the creation of an Account. The newsletter uses the email address provided by the User and information required by law concerning consent or the legal basis for sending electronic communications.
Subscription to the newsletter currently requires confirmation of the email address through a message sent to the address provided. The User may unsubscribe from the newsletter at any time.
Detailed rules concerning the legal bases, purposes and periods of data processing, data recipients and the rights of data subjects are set out in the Privacy Policy of the okulary-3d.pl Portal.
Data necessary to fulfil orders in the Store may also be processed under the rules set out in the Store Terms and Conditions and the Privacy Policy.
§ 13. Portal availability and liability
The Operator takes measures intended to ensure the proper and secure operation of the Portal.
Availability of the Portal may be temporarily restricted, among other reasons, due to:
a) technical work and updates,
b) infrastructure failures,
c) failures of external providers’ services,
d) security-related incidents,
e) circumstances beyond the Operator’s control.The Operator may temporarily disable a specific function if this is necessary to repair or update it or to ensure security.
Educational, technical and informational materials made available on the Portal are for informational purposes. The User should take into account equipment manufacturers’ instructions and the safety requirements applicable to the specific device, material or use.
Tools used for calculations, conversion, generation or image processing are auxiliary in nature. In applications requiring particular accuracy, the result should be appropriately verified.
No provision of the Terms and Conditions excludes or limits the Operator’s liability to the extent that excluding or limiting such liability would be impermissible under applicable law, in particular in relation to consumers.
§ 14. Complaints concerning Portal services
The User may submit a complaint concerning the operation of the Portal or a service provided by electronic means.
A complaint may be sent to:
The complaint should contain information enabling the subject of the report to be determined, in particular a description of the problem and, if it concerns an Account, the email address associated with the Account.
The Operator may request additional information if it is necessary to review the report.
Complaints shall be reviewed without undue delay and no later than within the time limit prescribed by applicable law.
Complaints concerning the sale of products in the Store shall be reviewed in accordance with the rules set out in the separate Store Terms and Conditions.
§ 15. Termination of the contract and deletion of the Account
The User may stop using the Portal’s free services at any time.
A Registered User may request deletion of the Account through the available Account functionality or by contacting the Operator.
The Operator may terminate the Account agreement or restrict its functionality in the event of a material or repeated breach of the Terms and Conditions, after applying measures proportionate to the nature of the breach.
Immediate restriction of access is possible where necessary to:
a) protect the security of the Portal or other Users,
b) counteract unlawful activities,
c) comply with an obligation arising from law or a decision of an authorised authority.Discontinuing use of the Account does not affect the rights and obligations arising from separate sales contracts concluded through the Store.
§ 16. Amendments to the Terms and Conditions
The Operator may amend the Terms and Conditions in the event of:
a) a change in the law,
b) the introduction or modification of Portal functionalities,
c) a change in the technology used to provide services,
d) the need to enhance security,
e) a change in the manner of providing paid services,
f) the need to clarify the rules for using the services.Registered Users shall be informed of material amendments to the Terms and Conditions in an appropriate manner, in particular through the Portal or by email, if required by the nature of the amendment.
An amendment to the Terms and Conditions shall not infringe Users’ acquired rights or the terms of paid services ordered before the amendment takes effect, unless the amendment is required by applicable law.
§ 17. Final provisions
Matters not governed by the Terms and Conditions shall be subject to the relevant provisions of Polish law and directly applicable provisions of European Union law.
The choice of Polish law does not deprive a consumer of the protection granted by mandatory provisions applicable in their place of habitual residence, where such provisions apply.
Disputes with consumers shall be resolved by the competent courts in accordance with applicable law.
Provisions concerning the online store, the purchase of products, payments, delivery, withdrawal from a sales contract, returns and product complaints are set out in the separate Terms and Conditions of the okulary-3d.pl Store.
The rules concerning the processing of personal data and the use of cookies and similar technologies are set out in the Privacy Policy of the okulary-3d.pl Portal.
The current version of the Terms and Conditions is available on the Portal in the “Portal Terms and Conditions” section.
